SETIT Platform Terms and Marketplace Agreement
Marketplace role SETIT provides a marketplace for homeowners to prepare and post project scopes and prices, qualified contractors to accept them, and the parties to complete their own construction agreements. SETIT is not a party to the homeowner–contractor construction agreement and does not perform, supervise, guarantee, or warrant the construction work. SETIT remains responsible for its own platform obligations.
Fixed-price acceptance The first contractor that satisfies the published qualifications and successfully accepts the homeowner's posted fixed price through SETIT's server-side acceptance process receives the conditional project acceptance. Homeowners do not select between competing bids. Acceptance alone does not execute the construction agreement and does not earn SETIT's fee.
Single included fee and posting credit The total SETIT marketplace fee is 10% of the accepted project price and is included within that price, not added to it. SETIT collects a 1% homeowner posting payment. That 1% is credited toward the total 10% SETIT fee and toward the homeowner's agreed project price. It must not be charged again. The remaining 9% is owed by the contractor to SETIT under the contractor invoice process; the homeowner is not separately charged 9%.
When the fee is earned SETIT's total 10% fee is earned only after the contractor and homeowner have both signed the same final construction-agreement version and the contractor has successfully received initial project construction funding, as verified in the project record. A contractor's acceptance, an unsigned agreement, signature alone, an uncompleted payment, or exchange of contact details does not earn the fee.
Contractor invoice and construction payments After the earning conditions have been satisfied, SETIT bills the contractor for the unpaid 9% of the accepted project price, with the 1% posting payment credited to the total fee. The contractor ordinarily collects construction payments directly from the homeowner. SETIT does not collect, hold, split, escrow, deduct from, or release those construction funds in the ordinary payment flow. The contractor is responsible for its construction payment arrangements. SETIT invoices only once for the earned remaining fee and credits payments already received.
SETIT absorbs its standard ACH processing cost for the contractor invoice; it is not added to the contractor's fee. No automatic bank withdrawal is authorized merely by accepting these terms. SETIT collects homeowner posting and consultation payments; debit cards may be used for those payments, with debit processing costs absorbed by SETIT. Debit is not used through SETIT for construction funding. Any credit-card surcharge must be independently lawful, permitted by processor/network rules, and clearly disclosed before use.
Contractor notices and signing The contractor supplies the construction terms and the legally required notices for the property's jurisdiction. Notices must be provided as required before signatures. The contractor signs the finalized construction agreement first; the homeowner signs the identical version second. A material change requires fresh agreement execution by both parties. Electronic-record consent and funding authorization are separate actions.
Cancellation, responsibility, and mutual separation Mandatory consumer cancellation and refund rights prevail. A party's request to cancel does not by itself prove fault. Where the fee was not earned, SETIT does not bill the contractor the unpaid 9%. Where the fee was earned, subsequent cancellation does not generate a second 10% fee. An unjustified contractor withdrawal requires the contractor to ensure the homeowner is fully reimbursed as required by the agreed settlement and applicable law, while the earned SETIT fee remains owed. A signed mutual separation may allocate the economic burden of the one earned fee equally between homeowner and contractor, with interparty reimbursements accounted for separately from SETIT's contractor invoice. No duplicate fee or duplicate collection is allowed.
Confidentiality and non-circumvention Parties may not misuse nonpublic SETIT introductions or project information to arrange a materially similar transaction for the purpose of evading an otherwise earned SETIT fee. Normal direct payment from homeowner to contractor is permitted and is not circumvention. Outside payments used to evade an earned fee must be reported and the earned unpaid fee satisfied within five business days. No fixed post-termination customer restriction is imposed; continuing confidentiality and accrued fee obligations remain applicable.
Disputes and limitations Class actions are waived only to the extent applicable law permits. SETIT's liability cap does not exceed the SETIT fee for the transaction, to the extent enforceable. No party is entitled to an attorney-fee award under these terms except where nonwaivable law requires otherwise. Nothing waives mandatory consumer rights or legally required remedies.
Records and account status SETIT maintains versioned acceptance, signature, posting-credit, funding-verification, invoice, and communication records. SETIT may end contractor participation with or without cause, subject to applicable law; termination does not eliminate previously accrued obligations.
