SETIT Cancellation, Refund and Mutual Separation Agreement
Mandatory rights and determination of cause Any mandatory consumer cancellation, rescission or refund rights control over these terms. Responsibility is determined from the actual project facts, signed agreement and applicable law; a party's request for cancellation alone does not establish fault.
One included platform fee The SETIT marketplace fee is one 10% fee included in the accepted project price, including the homeowner's credited 1% posting payment. The contractor owes only the remaining 9% contractor invoice after both signatures and successfully verified initial funding. If those earning conditions have not occurred, SETIT does not invoice the 9%. No cancellation or separation generates a second 10% fee.
Contractor-caused cancellation Where the contractor withdraws without lawful justification, the contractor must ensure the homeowner is fully reimbursed as required by law and the executed cancellation settlement. When the SETIT fee was already earned, the contractor's remaining invoice stays owed; the contractor must account separately for homeowner reimbursement and any recoverable work costs. SETIT does not bill the homeowner a second fee.
Homeowner-caused cancellation Where a homeowner is responsible for an unprotected cancellation, the actual agreement, lawfully recoverable completed work and documented costs determine any interparty balance. SETIT does not bill the homeowner for the separate 9% contractor invoice. The exercise of a statutory right is not treated as wrongful cancellation.
Mutually agreed separation A mutually signed separation may divide the economic burden of the one lawfully earned SETIT fee equally between homeowner and contractor, with appropriate interparty reimbursement if one party has borne more than its share. This is not a split of SETIT's contractor invoice and creates no additional fee. There is no automatic equal split without the agreement of both parties.
Section 7 — Completed services and nonrefundable processing costs Amounts attributable to actually completed services and processing charges that are genuinely nonrefundable, including eligible credit-card processing charges, are not refunded to the extent nonrefundability is permitted by applicable law and was properly disclosed. Mandatory cancellation, card-network, billing-dispute and refund rights prevail; no amount is characterized as nonrefundable solely because it was charged.
Closing records The settlement record must reconcile the posting credit, the contractor's SETIT invoice and any amounts paid, construction funds collected directly by the contractor, actual completed work, lawfully refundable amounts and interparty reimbursement, without double collection. The homeowners and contractors execute their mutual separation agreement; SETIT may record the outcome without becoming a construction contracting party.
