Homeowner–Contractor Project Construction Agreement
Contracting parties and incorporated project record The homeowner and the qualified accepting contractor identified in the final signed SETIT project record are the sole construction contracting parties. SETIT is not a construction contracting party. The parties adopt the completed, version-locked project scope, property, materials, exclusions, price, schedule, permits, required notices, contractor-specific lawful terms, and attachments displayed to them before signing. This document does not replace those project-specific records.
Scope, performance, and changes The contractor is responsible for performing the approved work, site safety, materials, subcontractors, applicable code requirements, permits, inspections, warranties and agreed schedule. A change of scope, project price or schedule must be documented and accepted in a signed change order before additional work, except where applicable law permits otherwise.
Construction price and payment credit The fixed construction price is the accepted price in the version-locked project record. SETIT's one 10% marketplace fee is included within that price, rather than added to it. The homeowner's 1% posting payment is a credit against the price and against the marketplace fee; it is not paid again. The homeowner pays the remaining construction installments directly to the contractor as specified in the signed project payment schedule. SETIT does not deduct 9% from, collect or release these construction payments. After both parties sign and the contractor's initial construction funding is verified, SETIT separately invoices the contractor for its remaining 9% fee.
Required disclosures and signatures The contractor must supply required project-specific consumer notices and contractor terms for the applicable property jurisdiction before signatures. Contractor signs first and homeowner signs the identical final document second. A material amendment after the first signature requires both parties to sign the revised version. Both receive the executed contract and records of electronic consent.
Completion, disputes, and cancellation The contractor and homeowner follow their signed project completion, punch-list, warranty, payment and cancellation terms and nonwaivable law. SETIT may provide project communication and document tools but is not responsible for the contractor's construction work or a guarantor of its payments. Protected cancellation and refund rights are not waived.
